1. Introduction
Please read these Terms and Conditions (“Agreement” or “Terms of Use”) carefully before using the website https://givingforchange.com (the “Site”) and related services (collectively, the “Service”) operated by GivingForChange LLC (“GivingForChange,” “Company,” “we,” “us,” or “our”).
By accessing or using the Site or Service in any way—including visiting, browsing, or creating a fundraising campaign—you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
These Terms apply to all users of the Site, including campaign organizers, donors, and other visitors.
2. Acceptance and Eligibility
By using the Service, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract. The Service is not available to users previously suspended or removed by GivingForChange. We may modify these Terms at any time by posting an updated version on the Site. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
3. Description of Services
GivingForChange provides a marketing and hosting platform that allows individuals and nonprofit organizations (“Campaign Organizers”) to create, publish, and promote fundraising campaigns (“Campaigns”) for charitable or personal causes.
GivingForChange does not:
Collect, hold, or distribute donations.
Act as a payment processor or escrow agent.
Guarantee the performance or legitimacy of any Campaign.
All donations are processed directly by the Campaign Organizer through an approved third-party payment processor, such as Stripe or PayPal, subject to the applicable payment processor’s terms and policies. GivingForChange provides visibility, promotional tools, and optional subscription features to help Campaign Organizers attract supporters.
4. Campaign Organizer Responsibilities
By creating a Campaign on GivingForChange, you agree that you are solely responsible for managing all fundraising activities, providing accurate information, complying with all applicable laws, payment processor requirements, and these Terms, including the Acceptable Use Policy contained herein. GivingForChange reserves the right to remove or suspend any Campaign or account at its discretion. GivingForChange may cooperate with law enforcement agencies, regulatory authorities, and payment processors in investigating suspected fraud, illegal activity, or violations of these Terms.
5. Fees and Payments
Creating a Campaign is free. However, Campaign Organizers pay a monthly marketing fee to keep their Campaign active. Fees are collected via Authorize.Net or another authorized payment provider and are non-refundable. Promotional offers may be provided at the discretion of GivingForChange.
6. Refund Policy
All payments made to GivingForChange for subscription or marketing fees are non-refundable. GivingForChange does not handle donor refunds; disputes must be resolved directly between Campaign Organizers and Donors.
7. Acceptable Use
Users may use the Service only for lawful, ethical, and authorized charitable fundraising activities and in accordance with these Terms.
You agree not to use GivingForChange to:
- engage in any illegal activity or violate applicable laws or regulations;
- create fraudulent, deceptive, or misleading fundraising campaigns;
- misrepresent your identity, organization, or intended use of donated funds;
- facilitate money laundering, terrorist financing, or other financial crimes;
- promote violence, terrorism, hate speech, harassment, or discrimination;
- raise funds for illegal drugs, controlled substances, weapons, counterfeit goods, stolen property, or other unlawful products or services;
- infringe the intellectual property rights of others;
- distribute malware, viruses, ransomware, or other malicious software;
- attempt unauthorized access to the Service or interfere with its operation;
- use the Service for gambling, pyramid schemes, or other prohibited financial activities;
- collect or transmit another person’s personal information without authorization;
- engage in spam, phishing, or deceptive marketing practices;
- use the Service in any manner prohibited by Stripe, PayPal, or any other payment processor used in connection with the Service.
- engage in any activity that may violate the policies of Stripe, PayPal, Authorize.Net, or any payment processor used in connection with the Service, including activities listed on their Prohibited or Restricted Business Lists.
- use the Service in violation of applicable economic sanctions, export controls, or anti-money laundering laws.
- impersonate another person, nonprofit organization, business, or government agency.
GivingForChange also reserves the right to reject, suspend, or remove any Campaign that, in our sole judgment, presents an unacceptable legal, regulatory, financial, or reputational risk, even if the activity is not expressly listed in these Terms.
Users are responsible for complying with all applicable federal, state, local, and international laws governing fundraising activities.
8. Intellectual Property
All trademarks, logos, and materials on the Service belong to GivingForChange or its licensors. Campaign Organizers retain ownership of their own campaign content but grant GivingForChange a non-exclusive, royalty-free license to host and promote it.
9. Copyright Policy (DMCA Compliance)
If you believe that content on our platform infringes your copyright, please send a notice to info@givingforchange.com with the required DMCA details.
10. Third-Party Services
GivingForChange may include links to third-party sites. We are not responsible for their content or practices. Use them at your own risk.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available.” GivingForChange makes no warranties about uninterrupted access, error correction, or campaign success.
12. Limitation of Liability
GivingForChange and its affiliates are not liable for any indirect, incidental, or consequential damages. Total liability shall not exceed $100.
13. Indemnification
You agree to indemnify and hold harmless GivingForChange and its affiliates from claims arising from your use of the Service or violation of these Terms.
14. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason. Sections that should survive termination (e.g., liability, indemnity) remain effective.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Virginia. All disputes shall be resolved in Fairfax County, Virginia.
16. Electronic Communications
By using the Service, you consent to receive communications electronically. You may withdraw consent by discontinuing use of the Service.
17. Severability and Entire Agreement
If any provision is found unenforceable, it shall be limited as needed. These Terms and the Privacy Policy constitute the full agreement between you and GivingForChange.
